Our clients travelled to the 390-room resort in February 2016 on a half-board basis, eager to explore the Costa Adeje landscape.

However, exploration soon turned to consternation as one by one, each family member succumbed to the debilitating symptoms of gastric illness.

Gastric illness

Floored by sickness, diarrhoea and stomach cramps the trio of holidaymakers self-medicated in resort.

Unfortunately, owing to the severity of the illness symptoms, the stricken family remained unwell on their return home.

Our clients claim to have witnessed numerous hygiene failings at the hotel Jardin Tropical and list their complaints as follows:

  • Meat would be served lukewarm
  • Cutlery and drinking glasses were not always clean
  • New supplies of buffet foods would be added to the existing selection
  • Food was uncovered

£4,150 settlement success

With their holiday ruined, the sickness stricken trio reached out to the legal experts at Holiday Illness Claims.

Experienced solicitor Sue Robinson handled the familys claim for sickness in Spain on a no win no fee basis, securing over £4,000 in total compensation from tour operator Thomson.

Commenting on the case, Sue said: I am delighted with this outcome and I trust that the family are too.

Whether holidaymakers stay on an all-inclusive basis or half-board basis, as the family above did, package holiday guests should expect to be protected from harm during their stay. The Tour and Package Regulations 1992 allow for a claim to be brought against a tour operator should they fail to ensure the hygiene, health and safety of their customers.

When sickness strikes, it is important that afflicted guests report their illness to their tour operator and seek medical attention, retaining copies of any receipts or costs incurred. This advice safeguards your health and provides evidence of the illness you suffered both of which can help to support any claim for compensation.

I would strongly encourage anyone else who has been unfortunate enough to fall ill at hotel Jardin Tropical within the last three years to come forward and obtain legal advice from the expert team at Holiday Illness Claims. You too could be entitled to thousands in compensation.
